Homeowners
in Long Branch
lose eminent domain battle

The tide ran out yesterday on a group of Long Branch
oceanfront homeowners, who lost a court battle to save their properties
from sei zure as part of the city's massive redevelopment effort.
A Superior Court judge in Mon mouth County upheld the city's
condemnation of the properties under the state's eminent domain statute,
saying he would "not second guess" the redevelopment project.
Attorneys for some of the homeowners immediately vowed to
appeal the decision.
The case involved two dozen homeowners living along the northern
strip of Long Branch's
beachfront, not far from where developers have already built a sprawling
complex of stores, apartments, luxury townhouses and condominiums
overlooking the water.
The residents were hoping to save their neighborhood of older,
oceanfront homes on Marine Ter race, Ocean Terrace and Seaview Avenue, which were all
targeted for the next phase of the ongoing, one- mile redevelopment.
While some of those living in the targeted area sold their
homes to the city's designated developers after Long Branch moved to take the properties,
others went to court -- claiming the city improperly changed the
redevelopment plan. They also argued that there were never any serious
efforts to negotiate for adequate compensa tion.
In a 60-page ruling late yesterday, Assignment Judge Lawrence
M. Lawson ruled in favor of the city on every issue.
The judge said Long
Branch had met its burden under the eminent domain
statute to show the area was blighted, as defined under the law. He added
that allegations by the homeowners that their properties were not in need
of redevelopment was "of no moment."
The city, he said, represented "substantial credible
evidence of a public purpose, and the court will not second guess the
city's decision. Nor will the court second guess where the city decided the
appropriate boundaries of the area should be situated."
Mayor Adam Schneider said the court ruling was a vindication
of "everything we've been doing."
At the same time, he said the city still hoped the homeowners
could negotiate settlements that would enable them to stay in Long Branch.
"They have refused to negotiate. We'd like them to stay
in the units in the new complex. We're hoping this brings them back to the
table," Schneider said.
However, William J. Ward, a Florham Park
attorney representing two of the homeowners, said they will likely appeal
the court decision.
"If you went down there, you would see these are very
nice vaca tion homes that have been converted to year-round use. They are
certainly not blighted, but under the statute that defines an area in need
of development, the judge declared them as blighted," he said.
"It goes way beyond the concept of what anyone thinks of blight."
